i filed a claim at paypal.

all i know is i payed for a pair of subs for $99.00
on 10/15/06 and i havent recieved anything.

fedex email say's it's your fault.

your telling me its Fedex's fault.

at this time, i dont care who's fault it is i just want
my money back.

THE ADDRESS IS NOT SHOWN, SO YOU HAVE TO CALL FEDEX.......
IF YOU CALL FEDEX THEY WILL TELL YOU THE PACKAGE WAS DELIVERED TO THE WRONG ADDRESS OF 5010.

While I will "GIVE MONEY BACK" When FedEx gives ME the money for the subs, by the way I DID NOT tpye the address Wrong, The FedEX employee did.
I had copied address from paypal ( in big black letters on white 4"x 6.5" shipping label)

This is the thing i dont understand you know it was sent to the wrong address and you still wont give me my money back?

Yes It is FedEx's Fault . It will be a few more days because if they cant find package they will refund my money and then I will refund Yours, OK

I don't know either of you, but if Fedex made the mistake, then wouldn't it be Fedex's fault?

And if it is their fault, they they should pay through their insurance, not the seller.....

This Kinda happened to me with my MECP books. they lost the Silver one and had to report a claim and i got a new one like 4 days later


They paid for it

yep this is one of them catch 22 subjects,
buyer paid for product...
seller sent product...
so one has money for product,
one dont have product,
seller did not ship to wrong address , fedex did
should seller refund money?...
IMO no he shouldnt, he didnt ship it wrong, but on the other hand buyer did nothing wrong, so you must let it take its time and course via the fedex claims,

its not fair to the buyer to be out money,
but then its not fair for the seller to be out of the product and money thats a double loss

like i said a catch 22

i wish i was there when 1jltoy was at fedex to conferm the shipping address.
i trusted him to make shur and he did not. i had no controll over what he did wrong.

as a buyer i am responsable for 2 things:
paying to his correct paypal address and giving him my correct address....i did both.

1jltoy i hope everything works out between you and fedex.
this is the second weekend without subs for the box i already spent money building.

all i want is my $99.00 back to buy some subs, why do i have to wait becuse of the mistake you made?

He said Fedex made the mistake. If this is the case, it is Fedex's responsibility. You paid for a product, he shipped the product. If he indeed gave them the right address, and they typed it in wrong or delivered it to the wrong address, it is on them, not him. It sounds to me like you found something else that you want to buy now, but already spent the money so you are having buyers remorse.

Not trying to be an ass, but by reading what you and he have posted, it sounds like you are trying to be an E-thug and force him to give you the money back, when it is very possible that Fedex is the one that owes the money, not him.

i have an email from fedex that says he made the mistake, i even posted it.
i cant prove who made the mistake only that one was made when he shipped.

and why does fedex owe me money?
if he did not conferm the shipping address when he sent the package he made the mistake. there is no buyers remorse its called paying for somthing and not getting it.

if it will help you out some, i live rite down the road from ken, and i can call him, ask him to come over and to bring the fed ex recipt and i can verify the address he put on the recipt so you will know if it was his fault or if it was fedex's fault?...im not tryn to start ****, just tryin to help out in a hard situation

and take a digital picture and hope it shows up good enough to see the address and post it as well

my stepded just talked to the neighbor this morning and
the guy said he took the box to the post office, not fedex.
i hope that helps you with your claim with fedex.


mr wig, you can if you want to but if he did not conferm the address
with them when he shipped, then he still made the mistake.

I did confirm Address on paypal & right now I am waiting on Fedex to refund my money. When I get my money you will get ours, I think thats fair.

Ruger, I understand you want your money back, but for the seller to give you your money back, especially if he hasn't made a mistake, would p9ut him in the same situation you're in.

I think it's fair to wait for Fedex to give him the money back, then he'll give you yours.

At least wait a few days to see if he gets the money from FedEx before making a thread like this. I realize how you feel, but I don't completely disagree with the seller.

I agree with Ruger. If you order something from Sears and they say oops, it got lost in the mail, we will give you a refund in 3 to 4 weeks when we get it resolved, would you be happy?

It is the sellers problem, not the buyer. He should refund the money and work it out with fed-ex on his own time, not the buyers. Thats how it works in the real world.

No actually it's not. I'll give you the most recent example. I ordered a Microsoft Certification book from Amazon.com a week ago and they sent me an e-mail stating their end of the transaction was complete. My book actually did get delivered to the wrong address, and I had to work it out with DHL myself. That's how all companies I've worked with are. If you buy insurance then the buyer has to sort it out with the shipper. If you don't buy insurance you're out of luck.

Well maybe I run my business different than some. I would never send out a product, then just wipe my hands of the deal.

as of now, both the seller and buyer are in a loosing situation. to make things fair, i say 1jltoy should refund half of the orginal payment ~$50. until he gets the problem solved with fedex, ruger should accept the partial refund.
